Full Job Description

To support fully the investigation functions and activities of the Office of the Chief Compliance Officer (OCCO).

In close liaison with the Associate Director, External Investigations, and / or under the direction of the Director, Investigations, to conduct and assist with investigations into allegations of prohibited practices (corruption, fraud, coercion, collusion, etc.) in relation to the Bank's operations. On occasion, the position may be asked to assist with internal investigations into allegations of suspected misconduct on the part of Bank employees.

Facilitating consultation and/or collaboration in joint investigations with other multilateral development banks and /or other co-financing institutions and contributing to the development of the Bank's integrity policies and procedures.

Background

The mission of the Office of the Chief Compliance Officer (OCCO) is to protect the integrity and reputation of the Bank, to promote ethical standards of behaviour and to strengthen the Bank's accountability and transparency. OCCO assists in identifying, assessing, and monitoring integrity risks arising from failure to comply with the Bank's standards and policies and contributes, in an independent manner, to the Bank's effective management of integrity risks. OCCO reports through the Managing Director, Chief Compliance Officer (MD, CCO) to the President of the Bank.

Within this context, the principal roles of the Principal, Investigations are:

  • to conduct, and assist with, Bank external investigations as part of the Bank's investigation function;

  • to fully support the Director, Investigations and Associate Director, External Investigations and MD, CCO in ensuring that the Bank maintains effective policies, resources and expertise to respond to allegations of Prohibited Practices such as fraud and corruption by its counterparties.


  • The Principal, External Investigations fully supports the MD, CCO, the Director, Investigations and the Associate Director, External Investigations in building and maintaining relationships with the investigative departments in the other MDBs as well as with relevant national authorities. The role also contributes to policy dialogue with other MDBs, including on mutual debarment matters, delivers presentations on debarment to external stakeholders, and contributes to the preparations for international conferences and workshops.

    Facts / Scale
    The Principal, External Investigations under the guidance of the Associate Director and direction of the Director, Investigations, undertakes investigations involving allegations of serious fraud or corruption by EBRD counterparties. The Principal, Investigations (External): prepares, or assists with, preliminary assessments and further investigation reports; undertakes and assists with investigation and compliance monitoring missions; contributes to proceedings before the Bank's Enforcement Commissioner and Enforcement Committee; and contributes to preparation of Enforcement Actions following Enforcement proceedings. On a needs basis, the Principal, Investigations (External) may be required to undertake internal investigations involving allegations of misconduct with regards Bank employees.

    The Principal develops standardised templates and policy documents, develops systems and processes as to debarment and cross debarment.

    In addition, the role contributes to OCCO's response to requests from national and international authorities for assistance with national investigations, and contributes to the preparation of witness statements and exhibits.

    The role contributes to the development of Bank policies including the Enforcement Policy and Procedures.

    The Principal carries out any other duties as assigned by the Associate Director, External Investigations, and the Director, Investigation.

    Accountabilities & Responsibilities
  • Accountable to, and supervised by, the Associate Director, External Investigations.

  • Responsible for assisting with or conducting investigations to the highest standard in accordance with the requirements of the EPPs;

  • Prepare investigation reports, settlement agreements, show cause letters, Notices of Prohibited Practices and other documents that are submitted to the Bank counterparties, the Bank's Enforcement Commissioner and/or the Enforcement Committee;

  • Ensure that investigative data on OCCO's case management system is complete and accurate;

  • Contribute to the mutual debarment process, processing cross-debarment referrals, as needed;

  • Contribute to and assist with high-level dialogue and cooperation with other multinational development institutions and international organisations in areas of mutual debarment, investigations and compliance.

  • Develop standardised templates and policy documents;

  • Conduct investigative missions abroad and attend relevant conferences, as necessary;

  • Perform quality assurance on Notices of Prohibited Practices prepared by other investigators;

  • Assist with providing advice to senior staff in other Bank Departments on matters concerning Prohibited Practices;

  • Deliver presentations and training to EBRD staff and external stakeholders on fraud detection and prevention techniques;

  • Provide substantive input to the Associate Director, External Investigations, and the Director, Investigations with regard to development of Bank policies and procedures; and

  • Fully support Associate Director, External Investigations, and Director, Investigations in undertaking special initiatives/projects and other ad hoc assignments.

    A postgraduate degree in law (LLM or JD), MBA or Master's degree in a relevant area (finance, banking, accounting), or a degree in a relevant area with an appropriate level of relevant professional experience.

  • Strong analytical and legal skills with the ability to interpret complex legal and financial information and to draft legal documents.

  • Demonstrated experience in undertaking complex investigations and litigation and managing own case load. Strong advocacy and liaison skills and proven ability to communicate with peers as well as to communicate with and manage EBRD stakeholders.

  • Experience with investigation policy development, including negotiations with IFIs and internationally, more generally (desirable).

  • Thorough understanding of EBRD's mission, mandate and processes.

  • Experience of the external investigation and integrity processes applicable to an IFI (desirable).

  • Excellent command of English, both written and spoken, together with the ability to draft in English to a very high standard; familiarity with other languages used in the Bank's countries of operation is a definite advantage.
